SC raises objections to Sharifs’ case petitions

ISLAMABAD: The government filed on Thursday a review petition before the Supreme Court against the disqualification of the Sharif brothers.

A set of four petitions has been filed under Article 188 of the Constitution (review of judgments or orders by the Supreme Court) read with Order 26, Rule 1 of the Supreme Court Rules of 1980.

‘We have also submitted a request along with the petitions to fix the matter as early as possible, preferably on Friday,’ Attorney General Latif Khosa told reporters.

He said the petitions were filed on the instructions of Prime Minister Yousuf Raza Gilani, who also holds the portfolio of law.

In reply to a question, Mr Khosa said the objections raised by the court office regarding submission of fees had been removed. He rejected an impression that the court had refused to entertain the petitions.

The court office had raised technical objections that the court fee challan and detailed judgment, which is yet to be released, were not attached with the review petitions and returned them.

Deputy Attorney General Agha Tariq Mehmood, who filed the petitions, told Dawn that since the petitions were moved after the banking hours, the fee challan could not be submitted.

Mr Khosa brushed aside a suggestion the petitions were filed in haste. The attorney general, who had assisted the Supreme Court in the disqualification case, said he might not appear before the court as the principal law officer, but all the preparations to fight the case would be made under his supervision.

A request has also been made in the petitions, Mr Khosa added, to allow the government to add further grounds after receiving the detailed judgment.

An informed source said that top leadership of the Pakistan Muslim League-N was on board about filing of petitions.

‘It is prayed that this petition may kindly be allowed and the Feb 25 short order as well as the detailed judgment to follow may very graciously be reviewed,’ the petition said.

The Lahore High Court had disqualified twice-elected prime minister Nawaz Sharif from a by-election on account of his conviction in the 1999 plane hijacking conspiracy case, but kept pending a separate petition against the candidature of Punjab chief minister Shahbaz Sharif until a decision by an election tribunal on a petition contesting his nomination.
